NEW YORK, NY, January 14, 2012 /24-7PressRelease/ -- The fact that DWI arrests are down in New York can be attributed to several factors, explains Seth Katz. First, there is less patrol officers trained now because of early retirement programs at the NYPD. There have been budget cuts and hiring freezes at every level due to current economic conditions. The fact is that drinking and driving continues to be a problem. Just because arrests are down does not mean that people are suddenly being more responsible. Remember "buzzed driving is drunk driving".

The fact is that the average person is subject to arrest if he has consumed any alcohol that affects his ability to operate a vehicle.
This is very subjective. Probable cause, necessary for the police to arrest, does not require much proof beyond an officer's observation or a motorist's statement that he or she "only had a couple of beers".

Objectively speaking, the average person (body weight and sex) is subject to arrest after about 2-3 drinks (not unreasonable say at a restaurant with friends). It takes about forty (40) minutes to one (1) hour on average to remove the effects of each drink. Do the math.

Most people arrested are at or near, the federally imposed (and adopted by the state), legal limit blood alcohol content (BAC)
(.08 in New York). This is a confusing message.

The next time you are at a "family" restaurant and alcohol is served; watch the people at the next table and how they are drinking. You will see them get up afterwards and put their kids into the car after they have "had a couple" of drinks.

Other countries have zero tolerance for DWI. In this country, that won't happen because it is essentially prohibition. The bar and restaurant industry would collapse.

Serious laws have been recently been implemented to stop people from drinking and driving with their kids. (Leandra's Law makes it a felony). Ignition interlock laws have also flourished.

Even at a low BAC threshold, if there is an accident involved, and property or personal injury results, the motorist's ability to avoid criminal conviction (and jail) are dramatically reduced.

People have to know that they are "guilty" if they are "buzzed" and driving That is DWAI, and DWI, even if they have only a couple of drinks.
